    Refuse to accept the delivery. Just say "no, send it back" and put your hands in your pockets and walk away.

    I was thinking along the same lines as Usarka.

    If you paid the shop for delivery and they arranged it - then its their responsibility to get you the bike they sold you to you in the same condition that you paid for it.

    The issue would be between them and the transporter.

    Nothing to do with you - refuse to take ownership of what you have and demand that you get the bike that you ordered.

    If you arranged your own shipping thats a different story tho' (sadly).

    So who arranged the shipping?

    got it from Ch Ch cuz it was the colour I liked.
    ownership already under my name.
    and it was the seller who arranged the shipping but not a dealer.

    You got a brand new bike from a private seller?

    Or was it 'just' really near new?

    (Not being smart - just trying to work out story to see if I can help anyways)

    That's bad news if the shipping was organised by the shop they should be Liable, if you need a quote/repair shop that does Hyosung and its not at your expense the red baron is a good place to go. But I feel your pain make sure they check wheel and front fork alignment for you, this is a pain with dropped and crashed Hyosung's as an owner of one I know. Don't worry too much get in touch with the guys you bought it off, and check shipping papers for legal information. GOOD LUCK

    I bought it from this private seller. from Ch Ch only because it was in the colour i liked. and more $$ here at Auckland even with the shipping added.

    and the worst thing is. I already have made a full payment for the bike -_-;
    pretty sure this guy will say "no refund"...

    So sad to say this but,

    You had no insurance - so no cover there (always have insurance).

    You didnt arrange shipping so no comeback there. But the seller will.

    You DID pay the guy $$$ for him to arrange shipping, but he is a private seller - you have LIMITED comeback on him. Unfortunately I doubt he will simply say "here is your money back" - I think you will end up having to go to small claims court to get the bike repaired.

    Argue you didnt get what you paid for and he didnt use appropriate shipping. He in turn will have to go at PBT.

    no mater what happens - I cannot see you getting a brand new bike - sorry.

    What did PBT say when they delivered it? Did you have to sign for it?
    If you did then that could be a problem, normally that means you accept delivery of item in good condition.
    Seems odd a private seller sold a NEW bike, is he a shop owner that sells privately?
