private dealer? Where is Frosty when you need him? Im sure that there are laws relating to "private dealers". I will go see what I can find.

If you did then that could be a problem, normally that means you accept delivery of item in good condition.
Seems odd a private seller sold a NEW bike, is he a shop owner that sells privately?
No,, fortunately I didnt have to sign anything. and yes, it happenes a lot with cars you know..

Hmmm any chance of writing the whole story from the start in one post - this will help.

    1. purchase - advertised where, by who.
    2. you've stated brand new - but a private seller - presumably a unregistered (not a licensed dealer). Did it come with a new bike warranty?
    3. the seller arranged all transport?
    4. wheres the bike now?
    5. have you made a formal complaint to the transport people yet so there is a record? - I find it very strange that there was no paper-work to sign accepting delivery.
    6. if I've read the past few pages correctly you had/have no insurance on the bike - what was offered by the seller until you received it.

A side note to all considering transporting bikes - use a dedicated motorcycle transport company (there are a couple) - it may be a bit dearer but they are set-up with ramps, tyre chocks etc. Dealers use these guys.

im this close to contacting "fair go" its just so fucked up, I just have seen the bike delievered from Mt Wellington PBT depo to workshop in Takapuna and this is how it arrived. now it fell on the other side.

I opened one container panel (front) and took away the plastic vinyl shit and this was how the bike was sitting. couldnt lift it up by myself. on top of that, workshop owner was pretty aggressive to me -_-

you will notice now the left hand side mirror has been snapped off as well, (also notice no brake lever from the way over here form Ch Ch... lever is sitting on the floor along with the side mirror) even from this photo alone. im sure there will be more damage.

best fucking day ever in my fucking 15 years of NZ life.

    this is fucking unreal.

those mother fuckers i am going to kill them.

ok lets clear some things here.

it was advertised on trademe as private sales.
he had it for less than a year. and it should be still under 1 year new bike warranty.
so yes technically it is 2nd hand but never been screwed or poked around with. last recorded warrant had 5km on the odometer.
seller did arranged all transport but I have already paid for the the bike and it is currently under my name.
seller has been pretty good to me and personally I dont think bike falling over on the way up here is his fault. (or is it?)
bike is currently at this workshop called Holeshot in Takapuna North Shore for quotation.
I have been to the transport PBT depo (yesterday) and talked to the guy (Tristan) who they said is responsible for this matter. no written statements tho.
I didnt have to sign anything when it was being shipped up here, im sure the sender did.
I personally have no insurance on the bike but PBT said they will fix it under their insurance. But that doesn't mean they can roll it around transporting it to the workshop, (not to mention from Ch Ch to Auckland) and Tristan refused to give me their insurance details saying that it was't his area. (whatever that means)

and the bike arrived in the workshop on its side.. again. pretty pathetic.
it is a fucking nightmare going thu all this shit which never should have happened.

nop no tie downs that were holding the bike. it was just SITTING there on its side. now that i look closely at the photo it sort of looks like a bin.. doesnt it? haha ive seen other bikes on the workshop which were delievered to them and it was very different to this one..

oh yea I almost forgot I also spotted a empty soft drink can that came with the bike.. haha I should have taken the photo of that too. lol workshop owner was being a mean ass tho i had to runaway from him hahahah scary looking dude.

yea I will try everthing I can to if nothing works then it will be Fair Go time.
always liked that show, never thought I wld actually think of contacting them regarding my own matters.
