Tough shit for him - from what you posted here his witness report is pretty shaky, he didn't identify the bikes going past very well at all. It is also his testimony (and he is only one man) against potentially 6 others. I am pretty sure that in law a judge cannot just dismiss the testimony of 6 people out of hand.
I reckon the pope would have some swing.
A useful experiment is to put yourself in the shoes of the other person: if you were a police prosecutor what would you say to these suggestions?
An occupational risk of policing is being lied to.
Timing is the crux. If someone comes forward soon after the ticket is issued and says "You have it wrong, it was me..." then the odds are good the first charge will be dropped.
But months later? Not likely. And an experienced district court judge is going to be similarly cynical. Which doesn't mean a judge can't be persuaded if the witnesses impress as honest and sincere.
It's not just a case af a fine, there is a mandatory 6-month disqualification period for a dangerous driving charge, and possible future implications on insurance premiums not to mention the hassle with Immigration at any Australian airport on arrival.
Lets face it, there are 3 people who could offer testimony here, other than the two charged and one of those persons partner. Two of these three have made it pretty clear that they is weasels.
It's now up to us to defend ourselves, at our cost.
In the mean time, I have learnt quite a lot from this situation. It's not a total loss.

Hey - I am just going from what I know from what was posted by Death here. I am happy to leave the finer details up to the defence lawyer. Maybe I am just being hopeful but surely 6 people all saying the same thing has a chance of swaying the judge?
I have no idea of what the conviction rate is for dangerous driving when the accused pleads not guilty - but from what I read here many believe it to be somewhere around 101%. Maybe you guys are right and no matter what Madness & Death have no chance - I just hope that is not the case.
