If she has decided not to make any more payments, then you can take her to Small Claims court.

If she out and out lies then you might waste your time (& $20.00) then you can send Dover round when he's drunk too much red wine and torment her

Or you could win and have an order for payment made in your favour and then you have a legally binding payment schedule! (Which you don't have now!)

    Good luck though babe.

Well, you're a muppet, and getting no less than you deserve... ghey I know, but a lesson well learnt one hopes

Take the laptop back. Then, if she feels hard done by let her take you to the disputes tribunal. The adjudicator will help you come to a settlement.

Whatever you do keep the payments up to date. No point doing your credit in over it.

Wait until you ring her before getting too fired up. It could be that her pay was mucked up - we had that recently where ANZ fd up big time - money didn't go in until 2 nites later then double paid us so on the Friday took payment out and froze my account (cos of the payment code in double paying us) so right after the xmas break no money until almost a week after our payday.

Or go and see her and take the laptop back until she finishes paying for it or if she doesn't want to pay - it is still legally yours!!

    Good Luck.

I'd say the latter is quite probable.

Yes. Do you know the saying "Trust no c**t" ? It's especially true while on the road but can also be applied quite well to life in general.

I'd check her out first if you ever get a contact. There may be a simple and forgiveable problem but it would pay to settle up or make some written contract at that point. If no luck with that then you'll obviously need to look at other options.

    GOODLUCK!!

Could be a legit reason the payment hasn't gone in....especially if her payments have been consistant I reakon.

Re whos responsible for full payment to finance company.....unfortunately its you, so yea its a bit of a drag if it turns out this girl isn't going to make any more payments

Ownership is not 9/10s of the law.

Title doesn't pass till paid in full is more like so the finance company can take back the laptop (it's still theirs... they haven't been paid out yet).

If it turns to custard the you can claim your out of pocket expenses from the other woman via small claims (now known as the disputes tribunal)

As someone else mentioned - it'll most likely be something simple and the money was forgotten or overlooked or there was a snafu at the bank. Whoever dropped the ball gets to be embarrased and make up and costs incurred...

So you gave her the goods on the promise of being paid? Hmmm.... I wonder if Noel Lemmings or Harvey Moron would do that for me?

I would ring, rather than txt.

If you think shes definitely ignoring your call, she may have your phone number in her cellphone, so shes not answering it. Ring her from a number she doesn't recognize that way shes most likely to answer and you can "catch er" on the hop...*pounce*

Just leave Dover on her doorstep and tell her that if she doesn't start paying up, he's there to stay....

That should get you the payments restarted PLUS a bit extra just to make sure....
