    Some useful info about carless driving charge.

    HI everyone for those who dont know my story...I just got DIVERSION from my carless driving charge, at first the duty lawyer said I wont get a DIVERSION for a traffic charge however I was told by a legal aid that I was able to apply for one. I past this info onto the duty lawyer and was given a diversion.
    As I didn't hurt anyone and was the first time I was charged (no record) so was able to apply for diversion.

    You can only use Diversion once, so, if you are a bit naughty and think you can get away with stuff on a never-ending basis, be warned!

    (not pointing the finger at you z99) Just a heads up for those who don't know.

    Carless driving would definitely have a positive effect on the road toll.

    Is there an equivalent charge for motorcyclists, or can we get busted for carless driving every time we go out for a pootle?

    That would be my guess; Carless use of a motorcycle.

    No. That falls under Dangerous Driving, apparently.

    Say pulling out of a stop sign and taking out a Police car, or overtaking a little old lady. Either one can be considered careless apparently.

    Careless use - hardly worth using up your one chance at getting Diversion on that sort of offence. Unless the 'offender' wants to maintain an absolutely spotless record, I'd suggest Diversion be put in the bank as it were, and saved for a 'criminal' matter should it ever happen in the future.

    I argue that if someone is concerned about say a prospective employer checking their conviction history, most would not be concerned with a careless use conviction. They would likely be more concerned about a conviction for dishonesty, violence, drugs etc. Some ask for traffic offences to be disclosed, some don't.

    Note that Diversion isn't generally an option with more serious driving matters as they tend to attract mandatory Disqualification and thats not something a Diversion officer can legally enforce, even as part of the contract that is normally signed between the defendant and the Police for normal Diversion.

    Also, Careless Use is sometimes the only charge left to chose from for incidents that aren't covered by an instant fine - eg a minor crash caused by merging for instance. Which is stupid quite frankly as it can mean a person ends up being summonsed to court rather than issued with a plain old ticket, but I digress.

    I say use your Diversion, wisely...!
