bugger, I hope your mate heals up soon.
bugger, I hope your mate heals up soon.
To every man upon this earth
Death cometh sooner or late
And how can a man die better
Than facing fearful odds
For the ashes of his fathers
And the temples of his Gods
John's feeling a lot better after a good night's sleep, so that's good to see.
Andy sent a text to say he has finished the ride, so that's also good.
And to top it all off in a nice way, one of our ewes has just given birth to triplets!
Yes, I am pedantic about spelling and grammar so get used to it!

I often wonder what peoples driving would be like if everyone had the right to sue.Originally Posted by Jackrat

Ah yes, but you can sue for damages these days, it's just not widely done and there are restrictions. ACC will cover the cost of rehabilition and compensation for lost earnings, but it may be possible to take civil action for punitive damages. Punitive damages are effectively the civil equivalent of a fine.Originally Posted by TwoSeven

In addition it is possible to sue for punitive damages as a result of personal injury suffered. These are a special type of common law damages which are designed to punish the the person causing the injury. Such damages are not awarded under the ACC Acts and it has been held in many cases that the Courts therefore have power to award them.
You can also, of course, sue for property damage (ie the busted bike). And, in some cases for consequential damage (eg you are a contractor, you have entered into a contract to do something, with a penalty clause if you don't come through. Because you get knocked off your bike, you can't complete the work you contracted for , and so you get hit with that penalty clause. You can , probably, depending on a bunch of stuff, sue for that penalty payment. (and maybe even for damage to trade reputation)Originally Posted by MacD
