it's not that the passenger was held accountable, it is that there is legislation that covers this sort of driving:Originally Posted by Skyryder

(c)Was being used by a fire brigade for attendance at fires or other emergencies, and at the time was being used on urgent fire-brigade service.
you'll note that it is not only the 5-0 that have this defence.
you may also notice that there is no requirement for police to have sirens activated.
