    How do I get on here?

    About 6 months ago my missus moved out. and i had to pay her a lot of money. < as it happens>.. i work away a lot so i rented the house out.
    Young fella, seamed ok.and his GF. we got on well.. anyway i went to OZ to get a job but it didnt happen.so i came back and moved into the sleepout downstairs. he said it was ok .so that was 2 weeks ago.. now he has moved out. and taking me to court. because i was on the property illegally.he owes me $500 in rent. and the power has been cut off. because he hasnt paid the bill.. the place is in a mess..... and the land agents arent helping a lot.
    seems to be all for the tenant..
    any advice..................................

    Did your rent agreement give you access to the sleepout ?


    Did your tenants agree to have you move into the sleepout ?

    If yes to either and you can prove it, you should be sweet.

    Doesn't sound good Kev.

    You need to get the present position confirmed so that all parties know and understand what the other parties are claiming.

    If you cannot reposess now, you can certaily apply to get a resposession order on the grounds that the tenant has vacated withiout paying rent and bills.

    Get advice from a contract lawyer however it is usually as first come first serve situation.

    Unless there is a bond/deposit to take, I suspect you will have to write off monies owed and put it down to experience.

    More info required. What was the arrangement, who signed the agreement, was there an agreement? Tenancy law is fairly black and white. PM me if you like.

    Thats sucks. If you got on ok before and they agreed to you moving back it sounds like they are just using an excuse to get out of some bills.

    mate, we had a verball agrement with great freinds.
    to rent to own a house...everything was going great....couple years later, they sold the house we had nothing to stand on and it ended up costing us $18,000. all down the shiter... we not freinds any more, i made sure we signed the paper next time we brought a house...... young and silly...

    Sorry to hear about your troubles, Kev. It's all very stressful and disappointing when this kind of thing happens with people you thought you could trust.

    I just wanted to explore the bit I have highlighted above - the land agents. Did you use an agent to find the tenants originally? Or were the agents managing the property while you were in Oz? Either way, they might have some responsibility here and it might be worth persuading them to pull their weight.

    Meanwhile, talk to Mom. She's a sensible woman and I'm sure she will have some valuable advice. Chin up.
