    In general a tenant must give a landlord at least three weeks’ (21 days’) written notice when they want to end the tenancy. A landlord may allow a tenant to give shorter notice. This should be stated in writing. A landlord must generally give a tenant at least three months’ (90 days’) written notice to end the tenancy. However, if the property is needed for the landlord’s family members or employees, or there is an agreement to sell and the buyer wants the property empty, then the notice period is six weeks (42 days). If 42 days’ notice is given the landlord must inform the tenant why the notice is not 90 days.

    EDIT: Do they have contents insurance you can claim your gear on to fuck up their no claims?

    This is one classic exemption I have seen:

    This Act shall not apply in the following cases:

    (n) Where the premises continue to be used, during the tenancy, principally as a place of residence by the landlord or by any member of the landlord's family:
    This means if the landlord or any of their family lives at the same address the Residential Tenanices act does not apply.

    You often see this catch because Kiwi's love to buy an investment property and get in flatmates to help pay it off. Well those flatmates have almost no rights, as they don't have the protection of the act.

    Two cents to think about.

    Were they allowed to sublet the room?? A lot of tenancy agreements say they can't.

    yea they do but they think that i was involed with the house getting robbed so dont think they will put it on there tab

    If you were living there (in fact, if any of your stuff was there) you should be able to claim on their insurance.

    That holds no water.

    They don't have to prove anything, and it is completely up to them what they claim for on their insurance policy - it's their policy.
