    Well, that is why it goes to court - as described - I see it as one person trying to intimidate another, mouthing off etc. and the other person making it physical, since it was our fellow poster who crossed the line to take it from verbal to physical, I see him as at fault.

    Others have different opinions and are welcome to them.

    It would be a different story (for me) if our poster said that it looked like the other guy was going to attack him or had laid a hand on him/pushed him etc. - but that isn't how he described it, just that someone was in his face.

    Theres a few paths to go down a) deny deny deny b) say sorry and take it on the chin c) self defence.
    I'd be pulling all your own witness statements (will need to be affidavitised for jews) and even character references ("he's a kitten and would never hit someone unless scared for his life") - do not, repeat, DO NOT trust that the cops has done any kind of job in taking statements that do anything other than back up himself.

    It would sure be interesting to hear the other side if the story.

    If something sounds unusual, it's normally because we haven't heard the whole story.

    Still, a judge will decide. If it's a big fat nothing, it'll turn into a big fat nothing.

    Back in the day (also in Oamaru) the driver of a car I was in got smacked through the open drivers window of the car by some guys who we had some history with. That guy somehow got off with self-defence. I guess it comes down to who tells the better story.

    In your original post you say he grabbed your collar, he had a mate so you were outnumbered. I'd say you had cause. Shame I'm not a judge.

    I agree with the being grabbed by him as the first strike, but because you got out of your car to escalate the situation I think you might be buggered.

    Mike said he got out of the (low slung) car to "explain" (not escalate!) to the concerned citizen that his exit at the other end of the street was obstructed!

    The concerned citizen's partner misread the situation and mistakenly rushed to his partner's defence by grabbing at Mike's shirt collar aggressively provoking an assault!

    Mike was forced to defend himself from this unsolicited attack by pushing out with his hand to fend off the attacker in order to calm things down and clarify the situation!

    Seems clear enough!
