    No you don't, you have to give 21 days minimum. Anything less than that is a trip to the Tenancy Tribunal. The Landlord can also move you out in 42 days if they say they are moving family in. They don't have to prove they moved family in, they just have to say they did.

    That 3 months notice we give is used by me to fix any issues that I know about so that the next people don't have to live with them. In the house we're renting now, we've spent $1300 fixing the mains power feed from the street to the house and the blocked sewer line. We've replaced rotten net curtains as well and fixed the chimney and firebox. We also paid $5k to have the roof renailed because we could see the problem getting worse. We found a 20 litre bucket in the roof space when we investigated the leak in the master bedroom. It was put there by the previous tenant. The leak was because it had filled up. We've not been paid back by the landlady, despite three trips to the Tenancy Tribunal. She let the agreement expire, assuming that we would have to move out and organised new tenants WITHOUT TELLING US. She lost that one.

    The landlady at the previous property was worse and despite multiple trips to the Tenancy Tribunal still hasn't paid back our bond 2 years later. She used to turn up unannounced for random inspections. When she was selling the property we had weekly Open Homes and we made sure the place was spotless and we left the property while the Open Home was underway. When the place sold, she didn't tell us and we found out from the Real Estate agent at a football game 2 weeks before the next crowd was moving in. I've yet to meet a landlord with any moral fibre or one who will follow through on any promise. If I was a landlord, I'd go broke rapidly because I'd want the place to be top notch all the time.

    Been a long time since I actually read the standard document, but I'm sure I recall provision for withholding rent by way of redressing tenant's unanswered claims for expenses relating to maintenance items the owner is responsible for.

    Assume the worst: there's no such provision. Do it anyway. Give her written notice, copy the tribunal and proceed.

    Despite all the arguments we've heard from Landlords saying that the Tenancy Tribunal is biased in the Tenant's favour, the Tenancy Tribunal has no provision in law to uphold a finding in favour of the tenant. We are owed $1300 by Oxygen Property from a rental in 2011 where they got people in to service the DVS in between us moving out and Oxygen doing their inspection. The DVS service man left a MASSIVE mess in the bathroom and every room with an outlet including a bath full of black water. Apparently this is a standard practice by Oxygen to avoid paying bond back. The photos we took and had witnessed by a friend who is a JP showed a house left spotless. Oxygen were a bit flummoxed but have yet to pay us. MBIE claim that they have no recourse other than to ask nicely. The reason we moved out of that property was because Oxygen took us to court WITHOUT informing us that they'd done so over unpaid rent, which we duly proved we'd paid via a phone call to the court in session. We emailed Bank Statements which added up to more than the amount Oxygen were claiming. We decided that it wasn't worth hanging about.

    If we did what you said, we'd be homeless and involved in a prolonged "request" process for recompense that would be ultimately futile. For every rental property there are dozens of people waiting to rent. Illegally removing a tenant and replacing them for bogus reasons and then denying Bond repayment is standard practice because ultimately the Landlord knows that MBIE is too toothless to do anything about it.

    The tenancy tribunal is definitely biased towards tenants, their founding documents require it. I'm OK with that, up to about the price of the bond, which, as you say is the effective extent of their remit.

    Beyond that both parties have recourse to civil law. And yes I know landlords are more likely to be able to afford that, hence the above advice.

    Which stands, btw. If you hadn't moved out you would have been warm and dry and with a decided fiscal upper hand, ethically if not legally. And I've never yet seen the polise evict a tenant for any reason whatsoever.

    Oxygen do sound like arseholes. Or at least culpably negligent. Same thing. As a general rule I like to do my bit to make sure arseholes from any walk of life whatsoever lose. Which isn't to say I'm often completely successful, but I have definitely cost a few arseholes some sleepless nights, which, while providing nothing by way of rehabilitation is nonetheless beneficial to all parties involved.

    They can find in favour of the tenant. They have no legal power to enforce that finding. Court is not an option for any renter I know. Not one. You have to suck it up and the Landlord/Property Agent has the capability to make a rental property the exact opposite of a home and there's not a thing you can do about it.

    They don't call the Police to evict you. They just get a court order and use movers to move your stuff out while you're at work.

    Court is pointless for anybody in the process, tenants and landlords will smile nicely and accept the tenancy tribunal finding, but actually getting any money is pretty much hopeless. Even with a court order your only real enforcement option is to take property to the value of what's owed, assuming you can find the other party and prove that the property belongs to them before it's seized, and even then it's up to you to sell it to get your money.

    Short answer is that the only real option is to bend over and get screwed, write off the money and carry on with your life.
