    cunning plan going down the gurgler...

    Just found out that their car was stolen from their new address sometime overnight... found it gone at 1145 this morning (probably when the lazy feckers woke up...)

    Had an immobiliser etc and was parked right outside the house where I saw it yesterday afternoon....

    Hoped the courts had seized it under the distress warrant I sought yesterday already, but no..........

    KARMA.......

    Most likely a dodgy insurance claim I think, but... who knows... perhaps one of their sack mates has let them know my plans and they are ridding themselves of it????

    Will look into it personally, now it is a criminal matter (and not a landlord tenant private issue...)

    Looking for a Green Mitsubishi Emeraude rego ADK313...

    Bugger... there goes my money..... hopefully I can find it intact and get the warrant executed by the bailiffs.....

    Attending cops think it is dodgy... has alarm and immobiliser, was parked right outside their window, down a drive right past another house, they have both sets of keys, there is no broken glass from any forced entry, all neighbours heard nothing, and they want a claim number straight away for the insurance.

    He went out in it at 0030hrs to go to an ATM machine... (funny time of night to go to the bank, but ideal time of night to hide/dispose/torch a car???)

    Some stuff claimed to be stolen from in the car is stuff we have in storage...

    Have started a seperate thread... reward to any KB finder of said car...!!!

    But... trailer needed urgently to deliver their rubbish filled trailer...

    And so are the days of our lives...

    Friday the 31st August, 9am, went to court to see how they were going to pay the bill, only they didn't show... SHOCK, HORROR!!!!

    Bailiffs NOW say, they go to their address and locate them, then formally bail them to appear at another date. If they don't turn up THEN, THEN a warrant is issued for their arrest. (Quite different to what was said would happen to them if they didn't front up for this one on the 31st...).

    Then at 2.30pm, the second application was heard about the repairs, costs, storage, trailer and tow truck fees, the property left behind, etc... and guess what... They didn't show... SHOCK, HORROR!!! Gotta give it to them, they have a 100% non appearance rate!!

    A further $560 odd awarded to us... but it will mean that I have to pay, at my expense, again, to get them ordered to court to say how they are going to pay, again... but that bill goes onto the costs already ordered...

    As for their property, I have to get a registered second hand dealer in to see what he wants to buy and forward the monies he may give me to Wellington "so there is a paper trail" so they can return the $$$ to me. Anything left behind is then deemed trash. Think I will be making another "delivery" of the trash to the trash...

    If this carries on much longer, you'll be rivalling Coro for the longest running soap opera.

    I've always believed in the saying "revenge is a dish best served cold" but the way this lot are dragging the chain it'll almost be frozen by the time you finish them off.......

    Norks being the most important thing to take into consideration of course........LOL.........hope you have that clause in your new tenancy agreement Pat.

    Well done keeping on keeping on with this, most ratbag tenants live and rely on the fact that most landlords simply put this kind of thing in the too hard basket. Have you looked into the National Tenancy Database? This is a REINZ backed database where you can register your bad tenants so others dont have the same issues as you have had.

    Wifes law firm said the same thng... "good on ya for sticking to it, most give up and they get away with it..."

    Wrong fella to try it on with in this case, like a pit bull on a chihuahua or a cat, ain't letting go for nothing.

    Will be registering with them soon, so all good, thanks for the advice throughout Mom...

    Agents here rang Tenancy and they said "You can't do it..."

    Probably more on a case of not being able to do it on their tenancy agreement form but your own private version must be different in some way??? Couldn't convince me that there was no way it could be done tho...

    Anyhoo, new tenant has the rent paid direct by WINZ and she then gets whats left after that, so guaranteed income every week now!!!

    Tenancy Law is an Ass! The 0800 number is manned by some well/and some not so well trained people, most importantly they are not Adjudicators and can not make decisions, they can advise. I used it all the time, and it has stood the test in Tribunal.

    Aint WINZ great! word of caution, your tenant has to agree to that happening and can cancel their agreement anytime. If your rent is late by one day, get in your car and go for a visit with a 10 day notice. I was singed by someone that cancelled their approval at WINZ. Keep real close tabs till you are sure is my advice.
