What I want to know is how did the boss find out about the clip?

Was there a camera person standing there filming at the time of the process when the boss was there?

Dosent seem like your fault at all, theres alot of outside factors here...

What was the boss doing on youtube during work hours?

He can not fire you on the basis of this clip if its not stipulated in your contact. How can you breach something that's not stated in a legal contract?

There are laws in place to protect employees from employers who try take their employees for granted. Weather its personal or professional dislikes this law is in place for a reason.

No such thing as a probation period, a performance review in 3 or 6 months etc is usually acceptable but no actual probation.

Legally you can not be instantly dismissed unless you breach your contract or the NZ law (sections of it are sometimes stated in the organisations' contracts)

2 verbal warnings 1 written and then dismissal, (I think) this procedure is in place to protect employees.

If a person who is not employeed within the organisation, made this clip then distributed it for public view, THEY are the ones who are in breach of the law due to the privacy act.

Unions can be handy at a time like this, if you are in a union talk to ya rep. If its a smaller organisation, take it up with Employment court.

    Good luck for Tues babe.

The camrea was set up on an adjacent building taking a frame every 30 seconds. The resultant frames were spliced into a movie clip. The clip was sent through to a one of the guys at work who could not view it only having Windows Media Player (the file is in .mov format) and I could view it in Quicktime. I got the clip and couldn't convert it to .wmv for all to see so I posted it to Youtube. Then I cut and pasted the url and sent it to all site staff including the boss. I did this so that all would be able to view it easily and for no other reason.

I accept that I made a mistake and will deal with it on Tuesday.

Just stick exactly to that story and just repeat it, if asked any questions, maybe throw in, how technology changes so quickly and is confusing at times - also gives some room to upskill you so this doesn't happen again (a point that the boss will look at)

He can't fire you for an honest mistake. Media and court will have the company for lunch if he does. Ask for the meeting to be in writing (nicely, state for your records and reflection) as well. Verbal means shit, also he won't abuse you in writing.

Have to be real careful posting stuff aquired from or on company time.

Oh hell yes!! The company cannot beat me up any more than I have myself. I feel like it was just such a dumb mistake for the sake of not asking first...

My employment contract (and policies and procedures guide) states that misrepresenting the company in any form is considered serious misconduct. It also mentions that nobody is allowed to say anything to the media (I assume that means youtube too) without the expressed permission from either the CEO, General Manager or other persons trained in media handling.

It's fair enough too, really. If I was running a company I wouldn't want someone on the front line bagging the whole service to the media hounds. It's not a good look and would likely hurt sales.

Even if it's amusing, a good general rule to follow is to leave work with work and anything else to playtime. I figure biting the hand that feeds you isn't the way to succeed.

EDIT: Having just read the outline of the video, that's a general mistake and I don't think you should be too hard on yourself. It wasn't the best decision but at least you're problem solving.

I'M STILL EMPLOYED! (by the same company I was last week!)

The big boss came in... at 2 pm on Tuesday (public hol Monday here) and was actually really good about things. He said that the reason behind the the problem was twofold. 1. Obviously the unauthorised release of information to the public. Fair enough - the company has been prosecuted by OSH before for safety breaches that were shown in pictures taken from a site. 2. I disregarded my immediate bosses authority - which he took offence to. I rode roughshod over his status as "The Boss" (of the site) All in all a storm in a teacup.

Yes I beat myself up probably more than I should have but the manner in which the site boss spoke to me left me of the opinion he wanted to fire me - that was his tone. He is a "Shoot first, wander over, put two more in the corpse, kick it, then not bother asking questions" kinda guy. Not altogether professional but that's his manner. I just have to learn to work around him (or with him)

So all is well in Colapopville! Yay me! Thanks for all the help and support (again) Colapop

    Good result mate.

I thought you might be used to that personality type (given your work history).

Mate, good time for me to pipe up about this now but the simple fact is you would've never been fired despite what your immediate boss is like.

You probably know how hard it is to find good people at your level of managment in the industry without taking someone good off the tools or poaching them.

A good leader knows who to keep on the team despite any "shortcomings". Probably got a rise watching you squirm though!
