    That's not always the case. If the person in front was reckless (and you were 2 seconds behind and under the speed limit) they can be at fault. 99% of the time though the story is that you were following too close and speeding. Especially on a bike.

    sinister, if the cops said she was at fault they will have documented that in the incident report. Ring the police and ask for the file and who they determined was at fault.

    If they say it's the other party at fault then tell your insurance to check again.

    Hes right, I think you don't have to pay the excess (except the special Learners and Restricted licence holders excess)

    The cops actually said that they have to put/and have put that it was my fault in the accident report. They said that from their point of view that shes a "stupid fuck" (similar words) and why would you suddenly stop in the middle of the open road when no cars or anything were in front of her.

    But by "the law" it says that I'm at fault because I should be able to stop, but what kind of bull-shit is that. What kind of terriost made that.

    Ahhh well if they put that in their report you're screwed.

    As for why someone might stop for no reason... Cat runs out.. Gearbox locks up.. Crap on the road you can't see... The list goes on.

    It's actually pretty obvious (for your own safety) that you should be able to stop quicker than the person you're following. If you couldn't stop it's 99% likely you were following too close or too fast.

    If you were being followed by a cage and you realised your tyre was about to burst you'd want them to have enough room to stop without running you down eh?

    Ohh well, I don't even think it's worth making the access of $800 payment. I'll just have to find some new front fairings and a new tank.

    EJ suggested some fibreglass fairings.

    Yeah worth checking out.. It's not just the excess they hit you with. Your premiums will be way higher for ages as well.

    I'm in the same boat after chucking my CBR down the track on Friday. Do I claim or leave the damage or just pay for some paint/parts myself. Pain huh?!
