I still don't really understand myself. Apparently, two years down the track, her expert witness was able to deduce (from the defendants testimony) that I was 83m away from her when she started her turn, leaving me with either , enough room to stop, or enough room to slow down and avoid her.

100k zone would be approx 3 seconds.

OK, lets say that if you had been paying more attention and had reacted more quickly, you could have avoided the accident. So how does that make it OK for her to fail to give way from a road with a give way sign on it and either cause an accident or make you take evasive action to avoid an accident?

truth, facts, fairness and a few others are rarely held up in court, like they say the law is an ass, and its true, the court is a game played by pricks, the prick in the big chair (judge) is a political appointment from his peers, and lawyers, well a few ive meet seem ok.....until their in the court room.
