That is not a bursitis, that is a proven injuryHowever, ACC, despite the referring doctor telling them, that the patient complained of a sharp and sudden, severe pain in his knee, on a given date, have decided that it is a gradual onset condition. Mind you, she will not go back on her diagnosis of bursitis despite the ultra sound and MRI saying he does not have it.
I am not sure how you can partially tear a ligament in a gradual fashion without any warning pain to let you know you are doing it slowly???????

Not quite. It's a deterioration of ligaments under & around the knee-cap that doesn't go away...it has to be monitored and can easily flare up again to the point that an operation can be the only cure.
Entitlement to a second opinion is always there, though a dianosis of an existing injury that has flared up is their defence as there's no telling when it was initiated or what caused it. ligaments deteriorate with age and you can't claim ACC for getting old![]()
ACC are shit bags, they will wear you out with a paper war, your age says it all and their responce will be 'your knee is degeneritive' age related, they even said the same about a fifteen year old lass recently....Pick your words very carefully with ACC, remember they have our money to fight us !!

Yes. I have had a number of people tell me about ACC denying claims on totally ludicrous reasons. I suspect they are doing exactly what you say. On the basis that a percentage of people will just accept it and give up. Those that contest it, they will delay and fudge a bit. If they finally have to admit they're wrong, they're no worse off. Cunts.

I am currently reading ACC's Statement of Intent 2009–2012 and their annual report to glean a bit more information. One of the ways they are saving money is to manage the claims they accept. New speak for decline as many as they think they can get away with hoping no one has the energy to complain. In breaking news I have just had a call from ACC - apparently they have now accepted my claim![]()
But you are only a young fella. How young bods can be degenerating is beyond me. There was a 17y/o girl that injured her knee and ankle in an accident. ACC accepted teh ankle but not the knee citing gradual process. They took ACC to the High Court and got the decision reversed.
