The bike belongs to you until such time that the insurance company actually pays you out, effectively buying the bike off you. Make your insurance claim and wait to see if they decide to fix it or write it off. If it's just sub frame damage they may fix it, but if it's new fairings, paint, stickers etc they'll probably write it off. Keep onto them to get the answer as soon as you can rather than just waiting for a cheque to turn up. As soon as they tell you they intend to write it off, then get it de-registered quick smart and get your money back. If you're sure it'll be written off then go and de-register it now. Your paper work from this will be dated thus covering your arse.
