    Who is at fault?

    So I am riding along today and a chick pulls a U turn, but she doesn't make it right around because there is a parked car on the side of the road.

    There is a van then a car in front of me.

    We all stop cause it is obvious she isn't going to make it - no drama.

    Next thing the chick making the u turn backs up - well she had to, had no choice. The van chose this point it time to go past her - so bang reversing car and van collide.

    Now, the chick pulling the U turn did it in a silly place and wasn't very competent, but hey - didn't the van perform an overtake, and thus the onus was on him to get it right?

    Buggered if I know - any cops or knowledgeable people care to comment?

    If your car is in reverse and you have an acident its your fault, one of my mates parked in his driveway but left his car in reverse, somone came and hit his car and he was at fault (at least by the police, he may of gotten off it in court if he went to court....)

    hmmm... very interesting question....

    Had she already started reversing when he drove behind her? If she was already moving then (regardless of the legalities) it was a very stupid thing for him to do.

    On the other hand if he was the first to start moving and she backed into him, I would blame her.

    How about working on percentages. Obviously they both behaved unwisely. But is it 50/50?

    Don't you have a rule here about people reversing giving way to EVERYBODY?
    It's only when you take the piss out of a partially shaved wookie with an overactive 'me' gene and stapled on piss flaps that it becomes a problem.

    Yip, both go for careless or at least a warning for careless and given a kicking. Then the insurance companies can blame both drivers and screw them both over.
