    Doesn't matter if it's new, it's a private sale. CGA doesn't apply. There are certain statutes relating to misrepresentation, fair trading and the like that have been applied previously by the courts though.

    I think its a lifan or something, saw one at a mall for sale, I wouldnt ride one for $100. the frame and swingarm are absolutly tiny as!

    I feel sorry for the person who bought it in the end, I wouldnt consider them to be roadworthy. I even had hesitations about the quality of the frame on their 250 virago knock off and that was much better built. Tyres looked to be absolute shite too on the one I saw.

    it does matter under the new motor vehicles sales act private sellers are under the same obilagtion as dealers,

    this guy should be run off the site,

    he says for 4000 he will do a warranty, suzuki do a warranty on a 3300 gn250, so he should,

    and he has no fucken i dea about bikes,

    Yep, under the Motor Vehicles Sales Act 2003 you'd have him on a number of things, although you would need to prove a number of things.

    With vehicles you can enter a phone number as part of the listing process. So I doubt they wouldn enforce it with vehicles if you added your number as a comment.

    Yeah, but it also says this, on the vehicle selling section:
    "In both cases potential buyers can contact you directly to ask you questions or view the cars."

    If he has at least 10 bikes he's selling, then he's a dealer. If he's a dealer, then he has to abide by regulation petaining to registered motor vehicle dealers selling new vehicles.
    ... and that's what I think.
