I'm with Flip . I'm glad you will never work for my company. Boys will be boys until shit happens & then it is the company owner who has to 'Man Up' & take the consequences for deadshit behaviour. I don't like the way OSH has gone but not liking it is not a defense when things go wrong . We are stuck with this wonderful new PC world & the days where this stuff could be tolerated are long gone, so get over it.

Wouldn't it just be easier to say, "If you are doing this in the carpark, while you're not on the job, you're officially not at work, and not my responsibility"? How far does your 'sphere of influence' extend? To the end of the driveway? To the door, if the person hasn't started work or has finished work for the day?
... and that's what I think.

Incorrect. A freezing worker was stabbed by a gang member in the works carpark. Works was prosecuted for failing to provide a safe working environment, crazy but true. I can't recall the final outcome.
A mate used to shout a few beers for his workers on a Friday night, not any more, if they had an accident & were injured there was the potential for him to be prosecuted
Pull wheelies in the carpark & the it is the boss who is at serious financial risk, especially if he knowingly fails to take action even if no accident occurs.
Like I said , if you worked for me I would find any excuse to get rid of you, an worker like that is a liability I could not afford to employ.

Last I heard, it was under appeal.
Basically, if a worker is injured on the work premises at any time, then the employer is liable unless what the worker was doing that caused the accident was expressly forbidden and the employer can provide a paper trail proving that the worker knew this.

Fun has nothing do do with it. If you ever work with me I promise you will not ever go home in a worse condition than you arived at work at.
Under the OSH laws the employer is responsible for every thing that happens on his site. This has nothing to do with your clock in time. If you are on his site or in his vehicle you are working under his rules.

+1 , I can be heaps of fun, in the right place at the right time. People doing dumb shit for which I will be held responsible & liable is not my idea of fun. Will the wheelie kid front for the legal costs & fines that could be incurred should this go pear shaped ' Yeah right '.
As an aside , I suspect if the carpark was open to public access , road rules might apply. If the carpark had restricted access solely for employees then OSH laws would take precedence .I would not want to be the poor bugger that was the test case.
It must be soooo boring working in a cotton wool factory.
