He then offered her a lift home , to which she un-graciously declined and started walkin'

liability for a passenger not wearing a seatbelt varies with age. Generally a driver is responsible for ensuring all passengers are wearing their seatbelts but specifically adult passengers are responsible for ensuring they are wearing their seatbelts.
