    Maori's are a protected species. You are not allowed to harm them in any way. This includes verbal abuse. You should have taken a beating like a man and respected his cultural beliefs.

    Yeah thats what I got told - if you strike as your defence its not looked on favorably but still within your rights.

    After working in that industry a few moons ago i'm not really supprised. Shit-for-brains is all too common on some of the lazy pricks that were on the end of shovels (or a EX200!!!!)

    This is serious stuff. You should NEVER let someone hit you first. It could be a 'lights out' situation.

    You have to choose to either attack by trying to get the first punch in OR defend by making sure his windpipe makes contact with your boot as you attempt to block his charge.

    Getting hit is not one of those two options.

    You cannot be prosecuted for assult if someone has got out of their vehicle to fight you.

    Good point there.

    If you can prove that you didn't approach his vehicle - but that he came at you, then you should be about half way there to prove self-defense! If the altercation happened near your motorcycle and not the ute then that should be easy.

    Did the cops get statements from the both of you at the roadside? Did you cover positioning?

    With regard to the "should have tried to calm the situation" bit from the cop...learn from that and next time: get off bike, mumble some calming words in his direction....then climb into him.

    agree with this.

    Plus - also think about the events leading up to him getting pissed off at you. Anything you do in the wrong - just make sure your case is watertight and have a statement for every senario he will try and get you on.

    Example for his argument to judge - You cut him off, he says you have done other stuff on bike after this (swerve at him etc) and then assault him.

    That's correct Jonbuoy, I have had this argument in court and won. "If you reasonably believe" and by his actions you had every reason to believe. And indeed why stand and wait for a king hit just to justify defending yourself. Good on you dude.

    Yea what the hell,i will put in $20 although i dont want it seen as some kind of anti cop thing,the way i see it the cop did his job as he must on the spur of the moment but i dont believe its the right decision,my $20 will be given on the facts being as outlined in the first post and to see the txting psycho put in his place,if someone wants to organize it then pm me with an account to put it in etc.
