So my translation of the above is:

You're both with the same insurance agency so no matter who is in the wrong, it comes out of their coffers. You have put in a claim but they don't want to pay so they're making payment conditional on her putting in a claim in the hopes of avoiding a payout on a totalled vehicle.

Yeah that sounds pretty much right. Whether she puts a claim in or not, the stupid bitch will give me the money I am owed for the bike. But I just wish she could hurry up so I can get the car I want (Have already found it).

Not even a station wagon, but will fit a drumkit in it, although most of it will be on the back seat, but that doesn't matter. She's a li'l 1500cc manual hatchback. A wee 1992 Nissan Pulsar. Good car.

Sorry to hear of your "accident". Well it truly was for you, but I am picking she had her thumb occupied too.

Hope you get back onto a bike soon. Well I know you will miss it, and once the finances are healthier, you will get your 600 and never be without a bike again.

I'm not sure what the cost is to file a claim with the Disputes tribunal, but if its still not much, I'd do it anyway. People will drag the chain as much as poss, hoping it will go away. years ago someone wrote off my car Long story short, I ended up having to pay for a lawyer and agreeing for them to settle out of court otherwise only my lawyer would have got any money.

Hurry her up by doing something yourself, if you only have third party the insurance companies dont go in to bat for you, you'll have to do the legwork. Make a report to the cops, if you leave it they wont even write it up, knowing you are only doing it for the money side of it. Start proceedings so she KNOWS you are serious. And/or, go around there and aske her/her folks for the cash up front, then they dont have hassles with insurance either. Have some evidence to back up your valuation of the bike.

That can be traced apparently. People have been caught cheating in tests because Telecom/Vodapone have records of when people were texting. Unless she didn't get a chance to send that text, that can be more evidence against her (if you haven't already got enough)

Claim finally lodged with insurance - the little bitch has changed her description of 'what happened' yet again, and still denies responsibility. This in spite of police report, witness statements, physical evidence and being charged with 'Failing to stop within....'. Insurance has been given all the info etc by me and still they say 'We haven't reviewed the file yet so we have to go on what our client tells us', Like we are not their client too. 3rd party cover is a complete have.
Adding insult to injury, the mother phones today, suggesting that without admitting liability, they are prepared to go halves on repairing the little cow's car. WTF!!
My fingers are crossed that the insurer finds in our favour and convinces the little cow to accept she was in the wrong.
Otherwise, next step is Disputes Tribunal.
She still gets to drive her heap of shit car around whilst a little boy waits

Perhaps you could have a quiet word with the insurance people that she has changed her story. The rozza report will back that up because it will have recorded what she told them.

Definitely report it to the insurance company regarding the changes in story. If they think they have a case for damages to her car, they'll get laughed out of court(if they take it that far) - just f's you off in the interim having to deal with a family of low lifes.

Hope the insurance company hurries up and sorts their shit out. Not nice dangling waiting for a yay or nay
