    pure speculation on my part but they will have seen it coming.

    What the OA will have to do is convince him or her self that there is no prospect of recovery, no voidable transaction blahdeblah. Not my field but the point of attach has to be when and how and for what consideration the assets were divested then what happened to the money.

    If there is no realistic prospect of recovery then the OA has a duty to not tilt at windmills.

    If you start naming names of the dodgy ones who have everything in the wife's name when things go tits up, it'll be a long list.

    Fortunately for these people, while they are still making (or, if you prefer, stealing) enough money, they can afford people to set their affairs in order so those they took it from can't get it back.

    Lots of people think this job is glamorous, well paid, and fabulous. It isnt. What I tell all our new staff is "We're plumbers son. Roll your fucking sleeves up and get your hand down the u-bend because we get paid to deal with people's shit". Plus its stressful, hard on family life and occasionally you want to strangle people.

    one of the interesting developments in trust practice over the last few years is called the "Hotchin clause".

    Its pretty easy to focus on this fuckwit right, but lets be realistic: he only ripped off one couple of $.5M. There is a schadenfreude aspect to it (which I am not exempt from) but compared with, say, the legalised rort that was SCF, the finance company collapses and the gross amounts of money made prior and after by those guys it is chicken feed. Plus only a very very small percentage were ever charged with anything, much less convicted.

    I still don't get the justification for the SCF bailout. The government never gives me my money back when my lotto tickets don't win.

    You aren't "too big to fail" and government guaranteed (P and I!) up to a million.

    It seems crazy now. and of course the influx of money pumped it up HARD so when it burst it was even uglier.

    If i knew high interest/high risk meant getting bailed out by the tax payer i would have put everything in there.

    Same as we (the tax payer) are paying 50% on non insured homes in the red zone.
