You have to have done something that would fall under Serious Misconduct in your contract. They can only give you a warning.... I'm sure someone else will be along witt the facts....

Just try not to hug them eh!
remember the Plumber in Tauranga who sacked a worker cause the kid drew swastikas and other Nazi shit on the home of a Jewish survivor of the war, the plumber ended up getting in trouble in the courts.

No such thing as "probation period". You're employed full time or you're on a set period contract. No grey areas and allowed anymore.

As you say: wait for the meeting and see what happens. They should just tell you you're a naughty boy and to go to their room...

Yeah. Probation period doesn't really mean much. It's really just a period that allows for more intense scrutiny of the employee and to allow for regular meetings regarding performance and improvements required. You can't just get the biff at the end of it just because they're a bit pissed off. They still need to have gone through a process just the same as they would for any other long term employee.
They do need to have told you what the meeting on Tuesday is about, that you are entitled to have a support person with you and what the possible consequences of the meeting could be. If they haven't done those then they're probably already in PG territory.
Hopefully it'll just be a smack on the hand though. Been there, done that, had a weekend to worry. Not fun.

Yep, he's correct! AND if your work for a "big" corporation then they will not risk a PG. I rection you'll be OK Col. But I still wont give you a hug.

It will blow over very quickly. (the issue, not the building).
Your boss is just suggesting to ask permission next time. Albeit, in a very clumsy, slightly rude way.
(secretly, he's probably impressed by the interest you have shown). No harm done.

Hmmm. Cheers. Interesting. It must be agreed too in writing at the start of employment.

Advise I received is that the Employment Court won't recognise probation periods. Must be wrong; damn word of mouth lawyers...

Yeah that was about 3 months or so back. The guy they went back for was dead as it turned out but it made good propaganda.

The courts look at them with a very suspicious eye.

There are cases where a probationary period is appropriate. Disabled employees is one example.

But the courts have repeatedly signalled that they will not permit a probationary period to be used as a means to evade the intent of the ECA.

A probationary period means "we're not sure if you'll be able to do this job but we'll give you a fair try". Not " We can sack you whenever we want for any reason".

Note that all the procedural requirements for fair dealing still apply during a probationary period. In particular, if the employer considers that "it's not working" they must discuss this with the employyee and make reaosnable efforts to make it work, including support, training etc.

"Probationary" and "trial" periods have notoriously been abused by unscrupulous employers. hence the suspicion with which they are viewed.

Misunderstanding I guess. They do recognise them but not as a means of terminating a person's employment.
