The tree fell and hit the road at the same instant the bike hit the tree. It wasn't sitting on the road until he hit it, it literally fell on his front wheel. Another second later, actually a split second, and the tree would have whomped Muppet, and we'd be attending a wake this week.

The only offence I can see him being charged with is felling a tree (a Rata, I understand) without resource consent.

Crimes Act 1961 Section 108. (6) Should a Police Constable lie it is gauranteed that he shall go to Prison with a freckle that is the size of a 5 cent peice (now discontinued0 and come out with a feckle this size of a 50 cent peice (old shape 50 cent) and be called Myrtle
