    Sit down right now, and write out clearly and concisely ALL of the events that transpired through the entire incident, right up to the cops arriving on the scene.
    You must do this now.
    The time that the court system will take will start to blur your memory.

    Write it all down now.

    Everything that was said. Every threatening action (especially involving the vehicle, as this was the first assault that you were having to defend yourself from).
    It might be possible for the communications record to be obtained for the phonecall that said dickhead was on at the time. Commencement of call plus duration of that call.
    The copper will have noted the time he/she/they arrived on the scene in their notebook.

    Did I mention that you have to write this down NOW???
    Also: put a time and date of when you wrote all this down on the paper.

    If i interperet your first post correctly, was'nt this asshole using his vehicle as a weapon?
    If so, then was this noted by the cops? I still don't understand why you were charged with assault as it appears obvious to me that it was self defence. I guess that they had fuck all to do and had to fill their notebooks up today.
    I normally don't knock them but this seems totally unreasonable given the circumstances. Would they rather this fuckwit had knocked you off your bike and then run you over?
    It certainly appears that way. They should be putting their time and effort into rounding these gangs that are currently going around Auckland and Really Assaulting innocent people for No reason at all. Guess that is too hard for them.

    Good point Finn and Westie. Possibly this company might have some safe driving policies or H&S type policies that driving and using a cellphone violates. certainly the issue at hand - i.e road rage, dangerous driving charge etc should be enough to prompt disciplinary action, and, depending on their company policies & their employee's history, perhaps dismissal.

    Would've thought HR dept might be more appropriate point of contact - or better still H&S advisor if they have one.

    Of course, this might be one of the sloppy operators so prevalent in NZ who have no interest in doing anything properly...and don't give a shit that one of their guys has done something like this in one of their company vehicles...but if that's the case then they should be "known" to some of my work colleagues...i will make some enquiries at work tomorrow and see if these guys are being "coached".

    on another note, really great to see the awesome advice and comments being offered by kb-ers, nice to note the absence of soap-boxes.... big ups to big-dave for his respectful thoughts.

    The guy in the ute sounds like a real dick. Good to see his firm being given some publicity about their employees behaviour in public as their representative.

    I wish ya all the best for seeing this guy get some form of slapping by the courts and you having your charge withdrawn. Good luck mate.
