Don't either of you have insurance?
If he is in the wrong, it is his liability to have the bike fixed, and his insurance pays, regardless of whether or not you are insured.

Yea i wouldv thought that too, He told the cops that he went through a orange which is impossible and my bike didnt have a wof at the time of the crash. I was gona get it that weekend. There wasnt enough witness evidence to charge him, this is what the cops told me after i called them a shitload of times without any replies. It happend over 3 months ago and i neva got a fone call from the cops or the guy that hit me, just got off crutches last week so iv been able to get my bike ready for sale!
The WOF issue is not a problem, as that is not why the crash occured.
No other witnesses? If you can find anything that could disprove his story, you'll be alright...
Also, last time I checked, running an yellow light is still a ticketable offence.
The question is, on a vulnerable motorbike, why would you run a red light in traffic?

the fact that the bike didn't have a WOF doesn't mean the insurance won't pay out. The only way the insurance can get away with not paying is if they can prove that the bike had a problem which was a contributing factor to the accident, its under section 11 of the insurnace claims act somewhere.
