    MF on trademe.. opinions please!!!

    so i buy this gazebo on tard me...a few days ago

    i asked before i bought it if i could have it in red...

    the answer ...yes sure..

    i pay, $450 bucks
    the tent turns up, and the tent is black.... so i send the seller a nice email..
    saying he made a mistake..

    he says.. nope you bought the black one,, i say no i asked if i could have a red one before hand,
    he says..oh that was another auction...etc etc

    i asked him to phone me. but he wont..
    i asked either to swap it for a red one or give me my money back.. he says the red one is more expensive,,, i go WTF..

    so i said if he doesnt either give me my money back or swap it.. i will fly down to chch... where he is located.. take my money back in items, and enought to pay for my flights and a bit extra for the hassle...

    most people know me as a fair person.. i wouldnt pull the wool over someones eyes.. but opinions please....

    Am i wrong?? im fuming at the mo....

    Was the auction for a black one?
    did he online accept your offer -ie did he in q and a actually say--yep no problem I will supply it in red for the same money?
    If not I'd suggest he is bang to rights supplying you the item in black.
    Ie you read the product description and bid acordingly.

    forget about it for at least 24 hours.

    You are not seriously suggesting getting on a plane to come down here and front the guy over $450 are you? You've heard of chucking good money after bad? That is the textbook definition of it.

    try and do a deal with the punter. If you arent happy, the worst case scenario is if youpaid with credit card, send him his stuff back, then get your card co to refund.

    If you paid cash/bank transfer, and you feel you have a remedy, and you feel you want to chase it, then off to the Disputes Tribunal.

    Have you in fact checked whether a red one is dearer? (get one of your mates to ask a qn on one of his other auctions)

    If you do end up keeping it, leave a red face for the guy, and you have a black gazebo.

    right..... dispute tribunal i like calling the cops....it never happens, cos as a defendant you can cancel it and reschedule. three times..
