Aaaaand more charges arrive for Giuliani. Y'all may recall how he stated outside the courtroom that he was telling the truth about the election workers interfering with the votes. In case anyone missed that he went online in a podcast or similar and repeated it. This time Ms Moss and Ms Freeman are not seeking money, he hasn't got any. They are seeking an injunction to stop him defaming them. If they get that and Giuliani persists, as seems likely, he could find himself deservedly locked up.

The Mrs who reads X/twitter read out to me that Trump wears "Depends" ie nappies for incontinent adults.
This is due to a lack of bowel control due to excessive drug use (Aderol) over the years.

Apparently the "malice" factor in the legal situation is such that bankruptcy will not protect Giuliani against the verdict. The women won't get 148 million but they should still get whatever he has, although the IRS too may take a chunk.

This is getting interesting. Two states have now barred Trump from running for President in their primary elections under Section 3 of the Fourteenth Amendment to the Constitution. States do have the power to run the elections held in that state but of course these rulings will be appealed to the Supreme Court.

S3 14th Amendment reads:
"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability."

My first reaction was that Trump hadn't yet been found guilty of insurrection. You will note though there is no mention of a requirement to be found guilty of anything, only "shall have engaged". Trumps lawyers have been forced to be creative. They claim the position of President is not an office in the terms of Section 3. Even more creatively (desperately?) they claim Trump did not swear an oath to support the United States Constitution. He only swore an oath to "preserve protect and defend" the Constitution.

Just today, a new development. Justice Neil Gorsuch, one of the nine Supreme Court Justices, when he was a Federal Appeals Court Judge ruled as per the attachment.

If the Supreme Court are to rule in Trump's favour it would seem they will have to be even more creative than Trump's lawyers.

Forty five years ago or thereabout an item was produced "God created a farmer." It has been parodied on a number of occasions but this latest takes the cake. Even some evangelical pastors think this goes too far as it refers to Trump with biblical verses describing Jesus. It should be hilarious but too many people will take it as gospel.

It's not that Trump impressed as being bright but yesterday was special. In the New York fraud trial the judge has already found him and other officers of the Trump Organisation guilty of fraud. What is being decided now is how much it will cost him. He asked to be able to address the court during the summation. This is unusual, parties to a case do not address the court, lawyers from each side sum up their case and that's it. The judge told him that if he was to address the court he must restrict himself to the facts of the case. He was not to make a campaign speech and he was given a deadline by which to indicate his decision. The deadline passed with no response.

Yesterday though the judge gave Trump the opportunity to speak and he immediately launched into an attack on the case, on the Attorney General, and on the judge. The same judge who is currently deciding how much he should pay. The Attorney General is seeking $370 million US. The judge told Trump's lawyer to control his client then adjourned for lunch. Trump didn't return after lunch, he held a press conference.

Whatever the judge decides Trump will appeal it of course, but his legal fees must be astronomical. He has not been using his own money yet, but he might soon be running low on other people's money.

"Legal fees" is a nebulous concept. Trump has just lost the case he took against the New York Times for information they printed about his taxes. Costs and legal fees for both sides were awarded against him, the NYT side alone toalling over $392 thousand. That's just one case of many and one which he didn't need to take.

It's potentially confusing but the first E Jean Carroll defamation case kicked off today. Trump's Lead Counsel is Alina Haba and her experience conducting the legal affairs for her husband's parking building is on full display. In Federal Court. The theatrics that the Trump team has displayed in the recent New York fraud trial will not be tolerated in the higher Federal Court.

The judge issued a ruling, Haba started to argue. The judge told her to sit down. He pointed out that his rulings did not invite discussion, his rulings meant discussion ceased.

There is potential for entertainment in the coming days.

While he was in court the first day he posted twenty times defaming Carroll on Truth Social. Well, he didn't post them but he had someone post them for him.

On day two one of Trump's lawyers jumped up and shouted "Objection." The judge asked him if he was a lawyer of record in the case. He was not, so the judge told him sit down. Apparently the lawyer is not even licensed to practice law in that state. This is not a crack legal team.

Morgan, and perhaps the most important banker in New York and thus the US, warned the Democrats that they were making a mistake demonizing Trump supporters. He even admitted Trump got some things “kind of” right, suggested rather radically that it was time people grew up “I mean, really?” he said “Can we stop that stuff” and “treat other people with respect and listen to them a little bit?”

Normally, JP Morgan can be counted to be on the same side as the big banker WEF cabal, or to some extent, driving it. Dimon has spent the last three months talking up Nikki Haley. So he is going right off the ranch here.

“I wish the Democrats would think a little more carefully when they talk about MAGA,” Dimon told CNBC on Wednesday from the World Economic Forum in Davos.

“I don’t think they are voting for Trump because of his family values,” Dimon said. “Just take a step back and be honest: He was kind of right about NATO. He was kind of right about immigration. He grew the economy quite well. Tax reform worked.”

Jamie Dimon seems be aware not only that Trump might win, but that the Democrats are fueling his campaign by maligning his supporters, in much the same way Hillary did when she called half the nation “Deplorables”. Obviously, if Trump wins, Dimon doesn’t want The President as an enemy. But it’s more than that — even though he’s speaking as if he’s a Democrat fan giving them advice — really he is backing slowly away from a trainwreck.

Earlier in the same interview he was passionate about the disaster that is uncontrolled immigration. He said “if you do not control the borders you are going to destroy the country”. Those are fighting words, not the tip-toeing “kinda right” verbiage, and it’s an implicit endorsement of the Trump trademark Build the Wall policy of 2016.

It’s as if he might have realized they created a monster. Destroying the country is a dynamite phrase. Even though both sides of the political spectrum will be listening to his every word, this is not kindly advice to the Democrats. Even if Democrats promised to “build a wall,” it’s too late now. Who would believe they’d do it come inauguration day? It’s way past that.

Quite possibly there’s another event cracking the socialist facade across the West, and that’s the unspoken dark hellfire of October 7th in Israel. That lifted the veil on the crazy pro-terrorist part of the Democrats — the apologists for baby beheading. If Trump is unable to run, either because of his legal problems, or his mental state becomes too obvious to ignore, the Democrats will need another candidate. Biden might not perform well against younger opposition.

Although Nimrata (Nikki) Haley is the leading contender in the absence of Trump, she is thought to be unpopular with the MAGA base. No surprises there. She might perform well in the upcoming South Carolina primary though. She was Governor there.

It's possible that neither of the two people who run for president in November is currently in the race. For some time now Gavin Newsom (Governor of California) has been positioning himself as heir apparent to Biden and he looks impressive arguing the Democrat position on TV.

Time will tell.

Was just watching a lawyer discuss the orange man's defamation case. Trump continues to post defamatory comments about E Jean Carroll on his Truth Social. Over twenty one day, forty two in the space of an hour another day. He must have them stored.

The lawyer feels that the jury will be made well aware of this, of his ignorant and arrogant behaviour in court, and his rudeness to the jury. Everybody stands as the jury enters or leaves the court. Not Trump. He apparently pushed in front of them as they were leaving presumably to start one of his press conferences. Well, he has form. He pushed in front of international leaders and walked in front of the queen.

Initially various pundits were guessing that the damages might be about double the five million awarded in the other trial. Now though, following his obnoxious behaviour, the sky may be the limit.

There is currently a postponement due to a juror being ill and Trump's lawyer Ms Habba having had a COVID contact. RAT tests all round and a pause in proceedings.

Further to my earlier comment about the Trump defamation case being delayed due to Ms Habba's claimed exposure to COVID and her saying she felt unwell. He will appeal of course - if he has enough money left. He was whinging about his financial state. I don't know how much time they get off for good behaviour in the US. In the corporate owned prisons it can be difficult to get the time off. The prisoners are inventory and the company needs to keep them there. An empty prison is a financial disaster to them and in the past they have asked for more people to be imprisoned.

In other news, Shawn Fein (how's that for an interesting name?) of the United Auto Workers Union has made an angry speech during which he called Trump a scab and announced the Union is endorsing Biden. A political pundit I follow had observed that the Trump team's closing arguments were so inept, and Trump's behaviour in court so disrespectful, that the jury would be very quick in reaching their decision. They were, even quicker than in the other case apparently, and they were thinking big. US$83.3 million big. That's quite a jump from the 5 million in the other case.

That 83.3 million is in addition to the five million. already awarded to her. Judge Arthur Engoron has said that he will release his verdict in the NY fraud trial before the end of the month. The prosecutor is seeking 370 million in that case.

On recent happenings in New York. Rudy Giuliani reportedly wants to appeal the massive award against him in favour of Ruby Freeman and her daughter. To do so he has to post a US$148 million bond. He can't do it. He hasn't paid his lawyers either so they won't fancy their chances of getting paid if they handle an appeal.

Similarly if Trump wants to appeal the $88.3 million he owes E Jean Carrol he will have to put up $88.3 million but the legal pundits are saying he has no grounds to appeal. Some people are pointing to inadequate representation meaning that his lawyer was useless. She was, but inadequate representation is not an option in civil cases.

Alina Habba keeps banging on about not being allowed to present evidence. The evidence and the witnesses she wanted to present were to argue that Trump did not assault EJC. The judge would not permit that. The courts have already found that he did commit the assault. This case was solely about how much it would cost Trump.

There is some evidence Trump only pays lawyers who win. If Trump keeps Habba on it's either because he's getting fringe benefits, or he can't get anybody else.

Roberta Kaplan, E Jean Carroll's lawyer, is reported as saying if Trump is going to appeal he has two options. He has to deposit the entire amount in a trust which will be forfeited if he loses the appeal, or he can pay a deposit and post the rest as a bond paying interest on the balance. Similar to how bail operates in the US. Kaplan also states that in the event he does neither she will commence collection action immediately.

The decision on the Trump fraud trial is in. He is fined US$364 million. He will appeal, but under New York law he has to post a bond of $364 million either from his own funds or by borrowing it - if he can find someone prepared to loan him the necessary.

To appeal the finding in his New York fraud case Trump was required to post a bond for the entire amount of the fine, plus interest. The sum approaching half a billion dollars is required to be paid if an appeal is filed, failing which the Attorney General could start liquidating his assets after thirty days from the date of the verdict.

He has filed a notice of intention to appeal with a request that the court halt proceedings and accept his offer of $100,000, 000instead of the near $500,000. The court declined his offer.

Aspects of the decision are quite complicated but the main part was straight forward and unanimous. The justices decided that in cases involving federal appointments such as president, Congress holds the power, not the states. States presumably still have the power to remove from the ballot a state politician they deem to have engaged in insurrection.

The court did not find Trump innocent of insurrection. I only mention it because Trump had requested that and will probably claim they did.

In really small places there may just be a meeting at someone's house apparently. Those who want to vote for Trump walk to one side of the room, those who want to vote for Haley go to the other. This process often takes place in halls. He has to sell or raise loans against his New York properties to pay the bonds. If he sells property he will have to pay city and state taxes on the proceeds, which means to raise half a billion he'll need to sell nearly a billion worth of property.

Cohen doesn't think Mar A Lago will be a target because that is not in New York and thus would involve another lengthy court case.

Debt to buy income producing assets is acceptable if you are in business (unless it's a residential rental in which case you are evil) and having cash on hand adds no value.

Your average person is not in business, so debt produces no income (and is not tax deductible) so only serves to provide income for the banks, whereas cash does produce income.

Of course Trump doesn't have the money, that's part of the point of the trial, that he inflated the value of assets to obtain loans which likely exceeded the real value of the security. In terms of asset value less debt his actual net worth may be bugger all.


But back to Trump, read his book look at his successes and fails.

Following his meeting with Trump, Musk posted on X that he will not be donating to either presidential candidate. That leaves many options though. He may donate to a PAC, he could pay legal fees, he might act as guarantor for a loan, etc etc.

Trump seems to have confused the legal process with a negotiation. That's not how it's supposed to work.


Update: The judge has denied Trump's request for a stay. The judge states Trump's problems are caused by his own dilatory behaviour. In English, he's too effing slow.

Update2: Trump has borrowed the $91.6 million bond to enable him to appeal.

If Trump wants to appeal the 350 odd million fine in the NY civil fraud case the law requires that he post a bond approaching half a billion, with interest, which would be forfeit if he loses the appeal.

Recently his lawyer Alina Habba went on TV and said Trump would have no difficulty paying the bond as he has "billions and billions and billions." Trump has now written to the NY Appellate Court asking them to waive the bond as he has found it impossible to raise the money. That would normally mean that the NY Attorney General can immediately start seizing his properties to recover the fine, but this is not normal, this is Trump.

We await developments.

There was also the time he was quizzed about his religious beliefs, his favourite bible verse, etc. He said that was personal and he didn't like to discuss it. He was then asked whether he preferred the Old Testament or the New. He said he liked them equally. If you were, you know, a Christian, you could be expected to have a preference for the New Testament. He didn't even know that.

The share float developments are hard to understand. Truth Social is basically failing, it has been losing about fifty million a year. It's not a competitor for Twitter/X, it basically just functions as a megaphone for Trump. The institutional investors won't touch this float with a barge pole, so it must be MAGAts investing their hard earned cash. That part of it which they haven't already donated to Trump or spent on his sundry worthless tat.
And the share value soars - for the present at least.

The 'God Bless The USA Bible' has been around for a few years at $49.99. Now that Trump has endorsed it the price is $59.99. Previously there were complaints that the pages stick together and that delivery was subject to lengthy delays.

Sundry items of Trump news - short version.

Y'all may remember Christopher Steel the former British intelligence officer who gave us news of the pee tapes. Trump sued his company in British courts and lost. Trump appealed, of course, and now he has lost the appeal too.

His $175 million bond in New York has been rejected by the court. This doesn't mean the AG will be coming for his property just yet. It means the company supplying the bond, not their normal line of business, failed to give all the required financial information. The court basically wants to know they have the resources to cover the bond.

The co-founders of Truth Social, Litinsky and Moss, have taken legal action in a Delaware Court against Trump reducing the value of their shareholding. Trump had earlier asked them to sign their shareholdings over to Melania but they had declined his kind offer. Trump assured the judge in Delaware that he would not take action to reduce the value of their shareholding meantime. Then went straight back to Florida and commenced a legal action against them in a Florida court. I have mixed feelings about this. He is obviously trying to shaft them but they sorta deserve that just for going into business with him. It's not as if they didn't know what he was.

Trump's financial troubles may be worsening. He is being sued by the guys who set up Truth Social and is counter suing them. He is being sued by the guy who set up the Special Purpose Acquisition Company that bought Truth Social in preparation for the float and is counter suing him.

He is apparently making moves to increase the number of shares available which will dilute everybody else's shareholding but increase his. I was wondering where the Securities and Exchange Commision were while all this is taking place.

There is a class of lawyers who represent shareholders in class actions against companies when they feel their rights have been breached. Some of these are reportedly already inviting contact from interested parties. The sharks are circling.

It's reported that the US Secret Service is in talks with the various authorities on the logistics of incarcerating Trump. The report is in the NY Times behind a paywall.

Trump has breached the gag order requiring him not to threaten witnesses or jurors up to thirteen times depending who you ask. Anyone else would have been locked up long since. If Trump does get locked up, he will need to be accompanied by his Secret Service detail. Special authority would need to be granted for them to be armed in a jail or prison. Presumably he would need to be kept seperate from the rest of the prison population.

Still, it's interesting that the possibility is great enough that the discussions are taking place.

I've read somewhere that there's been some filtering done in the secret service. Biden was worried enough when he got to the White House that they moved the MAGA Trump loyalists in the service over to Trump's guard. Biden got a fresh lot with no Trump affiliations.
I suspect if he goes to jail, the crew looking after him may have to be watched fairly closely. A run to Russia could be on. And the guard could well help.

WeÂ’ll have to wait and see how this plays out. Stormy DanielÂ’s has publicly denied signing at least one of letter. Then she doubled down in tv interview later and mentioned non disclosure agreement.
In any case itÂ’s likely trumps lawyer prob handled all this, they will need to prove trump ordered directly and hush money etc
People at this level know how the system works and are smart enough to insulate the man at top.

ItÂ’s a bit like say an overloaded speeding truck running someone over. ItÂ’s easy for cops to nail the driver and maybe the despatcher but hard to assign liability/fines to manager/owner.

LetÂ’s not forget all this is a scripted sideshow to distract us from other stuff.

He's not very good at covering his tracks so far, his whole operation seems somewhat, ummm, rudimentary compared to previous presidents.

I've noticed in the past how much fox omits to report on (cnn, msnbc etc quilty of this too) but man oh man fox is taking it to a new level with reporting on this trial! Clearly after reading the comments section, fox have magas believing the case is on the cusp of being tossed.
They are in for a big shock when the likely quilty verdicts come in. It is all engineered to give the look that this is a kangaroo court etc. Clearly angry triggered magas are good for businesses over at fox.

At what point does a news channel become liable of inciting likely violence through blatant lying.

On a side note, Hunter Biden is suing fox and they are already taking shit down. Too late fox! Possibly poetic justice on the way?

Fox channel has described itself as an entertainment channel not a news channel....so there is a possible out for them.

I would have thought someone would have had a shot at trumpfs legs with 38 or a 45 by now. The 45 being more appropriate.

This is interesting on a number of levels. Although the ethics expert mentioned says this is not illegal, inquiries have been initiated in both Houses of Congress.

Trump promised the oil companies an executive order on day one. Somewhat worryingly the companies are composing the appropriate executive order themselves. They don't believe Trump will have anybody in his next administration capable of doing so. In the latter days of his last administration legal documents were written by people who appeared to lack legal training. The concern seems justified.
